Welcome to Esurance and thanks for choosing us! Please read this Terms and Conditions Agreement (this "Agreement") carefully.

As used in this Agreement, "we," "us," and "our" refer to Esurance Insurance Company of Canada (herein referred to as "Esurance"). "You" and "your" refer to the named insured(s) identified in the application for insurance ("Application"), and any spouse of the named insured who resides in the same household. "Insurance Policy Documents" collectively refer to your Application, this Agreement, and all forms, endorsements, and notices issued to you by us, including any electronic communications.

By completing the Application and clicking "I Accept" below (or checking the box next to the final acceptance agreement [titled "Closing Agreement"] at the end of the Application and signing), you: (i) declare that you've read and completed the Application on your own; (ii) declare that the Application has not been completed by any other individual, including an insurance agent, broker, consultant, or representative, even if you have consulted with any such persons; (iii) agree to all of the terms and conditions contained herein; (iv) declare that the statements contained in the Application are true to the best of your knowledge; (v) agree to pay any applicable surcharges resulting from inaccurate statements in the Application; (vi) acknowledge that your insurance policy ("Policy") may be rescinded or cancelled and a claim may be denied if the Application contains any false information/misrepresentation, or if any information that would affect our underwriting decision has been omitted or misrepresented; (vii) declare that you have listed all drivers in your household, including any regular or frequent operators of the vehicle(s) described in the Application; (viii) declare that you have described any business or commercial use of your vehicle(s) in the Application; and (ix) agree that coverage will not be bound if your financial institution does not honour, or we do not receive, your payment.

Disclosure of Fees

Instalment Fee
You may be charged an Instalment Fee, as allowed by your province, if you elect to pay your premium monthly.

Late Payment Fee
You may be charged a Late Payment Fee of $5.00 for each payment that is not received by the payment due date.

Non-Payment Fee
You may be charged a Non-Payment Fee of $50.00 if the subsequent attempts to obtain the required payment through either Credit Card or Electronic Funds Transfer results in a dishonoured payment.

Cancellation Fee
If you cancel your Policy for any reason prior to the policy's expiration date, you will be charged the short-rate premium for the expired term.

Cancellation for Nonpayment of Premium

To keep your Policy current and avoid cancellation, your payment must be received by its due date. We do not accept partial payments of the invoiced amount. If your full payment for the invoiced amount is not received by the due date, a Late Payment Fee will be charged to your account. Any unpaid premium may result in the cancellation of your Policy. If a cancellation notice is generated, a cancellation notice will be mailed to the address shown on your Policy.

Electronic Transactions Disclosure and Agreement

Esurance is required by law to provide you with certain information in writing. In many cases, however, we can provide information and documents, including your Insurance Policy Documents, to you electronically instead if you consent. After you consent, you will receive all of your Insurance Policy Documents from us electronically, except as otherwise required by law. Insurance Policy Documents in electronic format will have the same legal and contractual force and effect as Insurance Policy Documents in paper format. We also reserve the right, in our sole discretion, to provide any Insurance Policy Document to you on paper instead.

In addition, you may request paper copies of your electronic Insurance Policy Documents at any time. Please call us at 1-888-ESURANCE (1-888-378-7262) to request paper copies, as well as to change your email address or other contact information that Esurance has on file.

By clicking the "I agree" button below, you (i) agree to transact business electronically through our website and by email (using the most current email address you provide to us) to, among other things, purchase your Policy, make payments, receive Insurance Policy Documents, renew and terminate or rescind your Policy, and send to us and receive from us electronic communications related to your Policy; (ii) agree to receive all Insurance Policy Documents electronically instead of by Canada Post or other physical delivery method — we may, however, provide certain Insurance Policy Documents in paper format via Canada Post or other physical delivery method; (iii) agree to electronically sign all documents in connection with your Application and Policy; (iv) agree that, to the extent any law or regulation requires that we "send," "mail," "send by registered mail," "deliver," "provide" (or the like) certain information, the moment we place an electronic document with that information in your online Esurance account, the moment an email with that information addressed to the most recent email address we have on file for you leaves our servers, and/or the moment we otherwise electronically communicate the information to you, such laws or regulations are deemed and presumed satisfied, and that you have in fact received the information; (v) agree that your electronic signature, including your clicking of an "I agree" button or an "I accept" button (or the like), serves as and replaces the need for your physical signature for this and all future transactions in connection with your Application, Policy, and Insurance Policy Documents, except as otherwise required by law.

Updating Your Contact Information

If your email address, mailing address, or telephone number changes, you must notify us by updating your online account with your new contact information, calling our customer service centre at 1-888-ESURANCE (1-888-378-7262), or sending an email to customerservice@esurance.ca.

Fraudulent Information Statement

Where (a) an applicant for a contract (i) gives false particulars of the described automobile to be insured to the prejudice of the insurer or (ii) knowingly misrepresents or fails to disclose in the application any fact required to be stated therein; or (b) the insured contravenes a term of the contract or commits a fraud; or (c) the insured wilfully makes a false statement in respect of a claim under the contract, a claim by the insured may be invalid and the right of the Insured to recover indemnity forfeited.
